Terms of Service

1. Agreement to Terms
By accessing or using Just11y's accessibility monitoring services, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.
2. Description of Service
Just11y provides automated accessibility scanning, issue prioritization, remediation guidance, and compliance documentation services. Our service includes:
- Weekly automated accessibility scans of designated websites
- Prioritized issue reports with remediation guidance
- Monthly Proof Pack documentation
- Integration with project management tools for ticket export
3. Account Registration
To use our services, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. Acceptable Use
You agree not to:
- Use the service to scan websites you do not own or have authorization to scan
- Attempt to probe, scan, or test the vulnerability of our systems
- Interfere with or disrupt the service or servers
- Use the service for any unlawful purpose
- Resell or redistribute the service without written consent
5. Fees and Payment
Service fees are as published on our pricing page. Subscriptions are billed monthly in advance. All fees are non-refundable except as required by law or as otherwise stated in these terms.
6. Service Limitations
No Guarantee of Compliance
Just11y is a tool to support your accessibility efforts. We do not guarantee compliance with any accessibility standards, laws, or regulations including WCAG, ADA, Section 508, or any other accessibility requirements. Automated scanning cannot detect all accessibility issues, and our service should be used as part of a comprehensive accessibility program.
No Legal Advice
Our service does not constitute legal advice. Proof Packs and reports are evidence of remediation efforts but do not guarantee legal protection. Consult with legal professionals for compliance guidance.
7. Intellectual Property
Just11y retains all rights to our service, platform, and methodologies. You retain ownership of your website content. Reports and Proof Packs generated for your account are licensed for your internal use.
8. Confidentiality
We treat your scan results and website data as confidential. You agree not to disclose confidential information about our proprietary methods, algorithms, or non-public features.
9. Termination
Either party may terminate service with 30 days' written notice. We may suspend or terminate accounts immediately for violation of these terms. Upon termination, you may export your data for 30 days, after which it may be deleted.
10. Limitation of Liability
To the maximum extent permitted by law, Just11y shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service.
Our total liability for any claims arising under these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Just11y and its employees, contractors, and affiliates from any claims, damages, or expenses arising from your use of the service or violation of these terms.
12. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
13. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of material changes via email or through the service. Continued use after changes constitutes acceptance of the new terms.
14. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
15. Dispute Resolution
Any disputes arising from these terms or the service shall first be addressed through good-faith negotiation. If unresolved, disputes shall be settled through binding arbitration in accordance with AAA rules.
